These terms explain the rules for using Care Notes.

1. Who we are

Care Notes (also known as MyCare Notes) is a UK-based software service operated by Drofmada Ltd ("we", "us", "our").

The service helps families and care organisations record care notes, time logs, bookings, and related care information.

2. Who these terms apply to

These terms apply to:

  • Individual users (including family members)
  • Care providers and small organisations
  • Anyone accessing or using the Care Notes service

By using the service, you agree to these terms.

3. Accounts and access

You must create an account to use Care Notes.

Accounts may represent an organisation or household, not an individual person receiving care.

You are responsible for:

  • Keeping login credentials secure
  • Ensuring only authorised people access your account

You must be at least 18 years old to create an account.

We may suspend or terminate accounts that breach these terms.

4. Care data and responsibility

Care Notes stores information you choose to enter.

We do not provide medical, clinical, or professional care advice.

You are responsible for:

  • Accuracy of data entered
  • Ensuring the service is suitable for your care context

Care Notes is a record-keeping tool, not a substitute for professional judgement.

5. Data protection and privacy

We process personal data in accordance with UK GDPR.

Our Privacy Policy explains what data we collect, how it is stored, and how it is used.

You must only enter personal data you are legally entitled to share.

6. Data processing and care records

Care Notes acts as a data processor on behalf of account holders, who are responsible for managing care records.

If an individual has questions or requests regarding care data, these should be raised with the account holder.

Care Notes supports lawful access to data and will act where required by law.

7. Plans, limits, and payments

  • We may offer free and paid plans with different limits (e.g. users, people cared for, logs).
  • Paid plans are billed in advance unless stated otherwise.
  • We may change pricing or limits with reasonable notice.
  • Failure to pay may result in restricted access or suspension.

8. Acceptable use

You must not:

  • Use the service for unlawful purposes
  • Attempt to access data belonging to others
  • Interfere with or overload the system
  • Reverse engineer or misuse the platform

9. Service availability

We aim for high availability but do not guarantee uninterrupted service.

Maintenance, updates, or outages may occur.

Features may change as the service evolves.

10. Early access and service evolution

Care Notes is an evolving service. Features may change, be added, or be removed as the service develops.

While we take reasonable care in operating the service, you acknowledge that it may contain bugs, incomplete features, or unexpected behaviour, particularly during early use.

11. Intellectual property

We own all rights to the Care Notes software, branding, and materials.

You retain ownership of your data.

By using the service, you grant us a licence to process your data solely to operate the service.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for:

  • Loss of data entered incorrectly
  • Decisions made based on recorded information
  • Indirect or consequential losses

Our total liability is limited to the amount you paid us in the last 12 months (or £0 for free plans).

Nothing in these terms limits liability where it cannot legally be limited.

13. Termination

You may stop using Care Notes at any time.

We may suspend or terminate access if:

  • These terms are breached
  • Required by law

You may export your data before termination, where reasonably possible.

14. Changes to these terms

We may update these terms from time to time.

Material changes will be communicated in-app or by email.

Continued use after changes means acceptance.

15. Governing law

These terms are governed by the laws of England and Wales.

Any disputes will be subject to the exclusive jurisdiction of the English courts.
